Welcome to The Digital Den ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website, services, CRM systems, communication tools, digital products, and any related content (collectively, the "Services"). By accessing or using our Services, you agree to these Terms.

1. Platform & White-Label Disclosure

The Digital Den utilizes GoHighLevel ("GHL"), a third-party CRM and marketing automation platform, to deliver certain Services.

White-Label Responsibility: You acknowledge that The Digital Den operates as a white-labeled service provider. While GHL powers certain features, The Digital Den—not GoHighLevel—is solely responsible for all client support, service delivery, and communication.

2. Use of Services

You agree to use our Services for lawful purposes only. You must not:

• Violate any applicable laws or regulations

• Interfere with or disrupt system integrity

• Attempt unauthorized access to accounts or data

3. Acceptable Use Policy (AUP)

You agree NOT to use the platform to:

• Send spam, unsolicited messages, or violate TCPA, CAN-SPAM, or similar laws

• Engage in fraudulent, deceptive, or illegal activities

• Harass, abuse, or harm others

• Distribute malware or harmful content

Violation of this policy may result in immediate suspension or termination.

4. Services & Modifications

We provide virtual assistant services, digital marketing support, automation systems, and digital products. We reserve the right to modify, update, or discontinue Services at any time.

5. Payments, Billing & Refunds

All payments are due as outlined at the time of purchase or contract agreement.

Retainer services are billed on a recurring basis (weekly/monthly as agreed)

Cancellation requires written notice per your contract terms.

Digital products and services are non-refundable unless otherwise stated.

Important: GoHighLevel (GHL) does not provide refunds. All billing and refund decisions are solely handled by The Digital Den.

6. Data Privacy & Ownership

You retain full ownership of your data

You grant The Digital Den a limited license to store, process, and use your data for service delivery

We comply with applicable data protection laws, including:

General Data Protection Regulation (GDPR)

California Consumer Privacy Act (CCPA)

You are responsible for ensuring that your own data collection practices comply with applicable laws.

7. Third-Party Services

Our Services may integrate with third-party platforms (e.g., Google, Facebook, Stripe, Twilio).

We are not responsible for:

• Third-party outages or disruptions

• Changes in third-party policies or APIs

• Data handling practices of external platforms

Use of third-party services is at your own risk and subject to their terms.

8. Results Disclaimer

We do not guarantee specific outcomes, including but not limited to revenue, engagement, leads, or growth. Results vary based on numerous external factors.

9. Limitation of Liability

To the fullest extent permitted by law, The Digital Den shall not be liable for:

• Platform outages (including GoHighLevel)

• SMS or email delivery failures

• Automation errors or delays

• Data loss or corruption

• Indirect, incidental, or consequential damages

You acknowledge that use of digital systems carries inherent risks.

10. Termination & Suspension

We reserve the right to suspend or terminate your access to Services at any time if:

• You violate these Terms

• You fail to make payments

• You engage in prohibited or abusive behavior

No refunds will be issued for terminated accounts.

11. Intellectual Property

All branding, content, systems, and materials provided by The Digital Den remain our intellectual property unless otherwise agreed in writing.

12. Governing Law

These Terms are governed by the laws of the State of Georgia, United States.

13. Changes to Terms

We may update these Terms at any time. Continued use of the Services constitutes acceptance of those changes.
